The digital revolution was then still a long way off. A resolution of the UN General\u00a0Assembly of 29 June 2012 stated that human rights also apply online and that privacy must also be\u00a0protected in the digital sphere.<\/strong><\/p>\n<p><strong>In addition, we consider that an explicit recognition of several digital fundamental rights as human rights\u00a0by the UN General Assembly is required in order to give them a correspondingly high priority. We are\u00a0convinced that the following points should be taken into account:<\/strong><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;3.19&#8243;]<\/p>\n<p>1. The right to privacy, the right to informational selfdetermination\u00a0and the equal right of participation in\u00a0media information and communication are recognised\u00a0as human rights.<\/p>\n<p>2. Any personal observation of an individual, his\u00a0behaviour, social contacts, use of the media or\u00a0communication without his explicit consent shall be\u00a0regarded as an unlawful interference with his private\u00a0life in accordance with Article 12 and his freedom of\u00a0expression and information in accordance with Article\u00a019 of the Universal Declaration of Human Rights.<\/p>\n<p>Everyone has the right to legal protection against\u00a0such surveillance, interference or impairment. When\u00a0exercising the state\u2019s responsibility to protect, narrow\u00a0constitutional limits must be observed. Unjustified\u00a0mass surveillance is impermissible.<\/p>\n<p>3. Everyone has the right to the protection of his\u00a0personal data. The confidentiality and integrity of all\u00a0relevant information technology systems must be\u00a0ensured.<\/p>\n<p>4. Everyone has the right to determine for himself\u00a0the collection, use, analysis, storage, correction and\u00a0deletion of personal data relating to him, unless\u00a0this conflicts with civic obligations. The obligatory\u00a0collection of personal data by state authorities must\u00a0be limited to an essential minimum. Everyone has\u00a0the right to receive information about all data and\u00a0information relating to him in a reasonable time and\u00a0format.<\/p>\n<p>5. Everyone has the right to protect his data, information\u00a0and communication against the knowledge of\u00a0third parties by choosing suitable means, in particular\u00a0with regard to public authorities.<\/p>\n<p>6. Everyone has the right to know which algorithms,\u00a0procedures, controls or criteria have become effective\u00a0in automated assessments or decisions concerning\u00a0him and to have them verified by a human being.<\/p>\n<p>Automated decisions and artificial intelligence must\u00a0be taken responsibility for by natural or legal persons.<\/p>\n<p>They must not violate human rights or discriminate\u00a0people for exercising their fundamental freedoms.<\/p>\n<p>7. Everyone has the same right to non-discriminatory\u00a0access to information and communication services.<\/p>\n<p>Access to the Internet must be a fundamental component\u00a0of public services without restriction, even in\u00a0times of political unrest. Network neutrality must be\u00a0guaranteed.<\/p>\n<p>8.
